The rules and guidelines for using Uncarcerated.org.

1. Acceptance of Terms
By accessing or using www.uncarcerated.org (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site. We may update these Terms from time to time; continued use of the Site after changes constitutes acceptance.
2. About Uncarcerated
Uncarcerated is a nonprofit organization based in Gainesville, Florida, that provides resources, community forums, a creative marketplace (UnStudio), and educational tools for justice-impacted individuals and their families.
3. Account Registration
- You must provide a valid email address and verify it to access interactive features.
- You are responsible for maintaining the confidentiality of your password.
- You must be at least 13 years old to create an account.
- One account per person. Accounts are non-transferable.
- You agree to provide accurate information and to update it if it changes.
4. Acceptable Use
When using the Site, you agree not to:
- Post content that is hateful, threatening, harassing, or promotes violence
- Impersonate another person or misrepresent your identity
- Share another person's private information without their consent
- Post spam, advertisements, or solicitations outside designated areas
- Upload malware, viruses, or any harmful code
- Attempt to access other users' accounts or private data
- Interfere with the operation of the Site or its infrastructure
- Use automated tools (bots, scrapers) to access the Site without permission
- Use the Site for any unlawful purpose
5. User-Generated Content
Discussions
Content posted in Discussions is public. By posting, you grant Uncarcerated a non-exclusive, royalty-free license to display your content on the Site. You retain ownership of your original content. We reserve the right to remove any content that violates these Terms or our community guidelines.
UnStudio Creator Content
Creators retain full ownership and intellectual property rights to all content they upload to UnStudio. By listing content on UnStudio, you grant Uncarcerated a limited, non-exclusive license to display, promote, and distribute your content through the Site for the purpose of facilitating sales and discovery. This license ends when you remove your content from the platform. Uncarcerated takes no percentage of creator earnings—all proceeds from sales go directly to the creator via Stripe.
Content Responsibility
You are solely responsible for the content you post. Uncarcerated does not endorse user-generated content and is not liable for any claims arising from it.
6. Community Moderation
To maintain a safe and supportive community, we reserve the right to:
- Remove, edit, or hide content that violates these Terms
- Suspend or terminate accounts that repeatedly violate community standards
- Use a community flagging system where users can report inappropriate content
- Make final decisions on moderation disputes
7. Donations and Payments
- Donations are processed securely through Stripe. Uncarcerated does not store payment card information.
- Donations are voluntary and generally non-refundable. If you believe a donation was made in error, please contact us.
- UnStudio purchases are transactions between the buyer and creator, facilitated by our platform and Stripe.
8. Resources and Information
The resources, guides, and information provided on this Site are for informational purposes only and do not constitute legal, medical, financial, or professional advice. While we strive to provide accurate and up-to-date information:
- Resource availability and eligibility requirements may change without notice
- Legal rights information is general in nature and may not apply to your specific situation
- Always consult qualified professionals for advice specific to your circumstances
9. Mentor Match
Mentor Match connects users for peer mentoring. Uncarcerated facilitates introductions but is not responsible for the conduct of mentors or mentees. Mentor Match is not a substitute for professional counseling, therapy, or legal advice.
10. Intellectual Property
The Uncarcerated name, logo, website design, and original content are the property of Uncarcerated. You may not reproduce, distribute, or create derivative works from our proprietary materials without written permission. This does not apply to user-generated content, which remains the property of its creators.
11. Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
12. Account Termination
We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or for any other reason at our discretion. You may delete your account at any time by contacting us. Upon termination, your right to use the Site ceases, though some content you posted publicly may remain visible.
13. Limitation of Liability
To the maximum extent permitted by law, Uncarcerated and its officers, directors, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including but not limited to loss of data, loss of income, or personal injury.
The Site is provided "as is" and "as available" without warranties of any kind, either express or implied.
14. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Alachua County, Florida.
